Graves Demands Red Flag Provisions be Stripped from FY2022 NDAA
WASHINGTON, DC – Congressman Sam Graves (MO-06) joined Republican colleagues to ask conferees to strip a Red Flag law provision from the FY2022 National Defense Authorization Act (NDAA). The members sent a letter to the chairs and ranking members of the House and Senate Armed Services Committees expressing grave concern over Sec. 529 of H.R. 4350, which would grant military courts the authority to strip servicemembers of their Second Amendment rights without due process and without the servicemember being present in court to defend themselves.
“Every single day, brave American servicemembers serve in harm’s way to defend our nation, our way of life, and the very constitutional rights that Sec. 529 would erode,” the members wrote. “This dangerous provision must be excluded from the final package.”
“The NDAA is supposed to be about supporting our troops and giving them the tools we need to keep our country safe,” said Graves. “It’s unconscionable that liberals would try to sneak a provision into this critical legislation to unconstitutionally strip servicemembers of their Second Amendment rights. This provision must be removed from the final bill, just like it was last year. I am strongly opposed to red flag laws and will continue fighting to protect the Second Amendment rights of our servicemembers and all Americans.”
